These terms govern your use of the Vela Air application and services operated by Vela Air Ltd (“Vela Air”, “we”, “us”). By creating an account, you agree to these terms.

1. What Vela Air is — and what it isn’t

Vela Air is a supplementary flight planning and situational awareness tool. It is not certified avionics and must not be used as a primary navigation or safety system. The pilot in command remains solely responsible for all decisions made during flight, including route selection, airspace compliance, fuel management, and emergency response.

Airspace data, NOTAMs, weather information, and terrain data are sourced from third-party providers and may be incomplete, delayed, or incorrect. Always cross-check with official sources and carry appropriate backup navigation.

2. Accounts and eligibility

You must be 18 or older to create a paid account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately at [email protected] if you believe your account has been compromised.

You must provide accurate information when creating an account, including licence details and aircraft weight-and-balance data where applicable.

3. Subscriptions and payment

Paid subscriptions are processed via Stripe. By subscribing you authorise Stripe to charge your payment method on a recurring basis (monthly, annually, or seasonally, depending on your chosen plan).

• Free trial: Each paid plan includes a 14-day trial with full feature access. No charge until the trial ends.
• Renewal: Plans renew automatically. You will receive advance notice before any price change takes effect.
• Cooling-off period: Under the Consumer Contracts Regulations 2013, you have 14 days from first subscribing to cancel for a full refund, provided you have not begun using the paid features. Requesting access to paid features during the 14 days constitutes a waiver of the statutory right to a refund for the period already consumed.
• Cancellation: You may cancel at any time from your account settings. Your access continues until the end of the current paid period; no refund is issued for unused time beyond the 14-day cooling-off period, except where required by law or where we have made a material change to the service.
• Payment failure: If payment fails, we will retry over a 30-day grace period before downgrading your account to Fly Safe. Your data is retained for the full grace period.
• Seasonal plans: Seasonal plans cover a fixed window (e.g. March–September for Pilot/XC, April–October for Free Flight). Outside the season your account automatically downgrades to Fly Safe and upgrades again at the start of the next season, with no action required from you.

4. Acceptable use

You may use Vela Air only for lawful purposes and in accordance with these terms and our Acceptable Use Policy. You must not attempt to reverse-engineer the application, scrape data, share your account, or use the service in ways that could harm other users or our systems.

5. Emergency features

The Mayday alert feature broadcasts your GPS position as an emergency signal. It is not a substitute for declaring a distress call on 121.5 MHz or squawking 7700. Misuse of the Mayday feature may result in account suspension and may constitute a criminal offence.

6. Liability and disclaimers

To the fullest extent permitted by law, Vela Air is not liable for any loss, injury, or damage arising from your use of the application or reliance on information it provides. This includes but is not limited to errors in airspace data, weather information, terrain data, or navigation calculations.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.

7. Data and privacy

Your data is handled in accordance with our Privacy Notice. Deleting your account triggers cryptographic erasure: your personal encryption keys are destroyed, making your data permanently unrecoverable.

8. Changes to these terms

We will give 30 days’ notice before making material changes to these terms. Continued use of the service after that period constitutes acceptance of the revised terms.

9. Governing law

These terms are governed by the law of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection law in your country provides otherwise.
